ORDER:

                             The Learned counsel for the JDs has made a statement that in compliance of the order dated 31.7.2014, the claim of the DH/complainant has been settled as per report of the surveyor and cheque  of Rs.41846/- bearing No. 685613  dated 13.8.2015 has been given to the counsel for the complainant for full and final settlement of the claim.

 2.                        The Learned counsel for the DH has also made a statement that he has received the aforesaid cheque under protest and withdraw the present execution petition but against the report of Surveyor, he would file a fresh complaint.

3.                          In view of the aforesaid statements of complainant and the learned counsel for the JDs, the present execution petition is dismissed as withdrawn. The parties concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
