This day is fixed for passing order in respect of M. A. case being No. 39/2023.

Ld. Advocates of both parties are present.

The record is taken up for passing order in respect t of M.A. case being No. 39/2023.

On 23.03.2023 the complainant has filed this M.A. case supported by an affidavit , praying for passing necessary order by directing the Op No.1 to submit the copy of the Policy Certificate of Insurance Policy bearing No. OG-19-1803-1826-00004636  on the grounds that the complainant has submitted the original Policy Bond before the OP No.1 Insurance Company, without keeping any copy of the same in her custody due to which she was not in a position to file any copy7 of the Policy Bond along with complaint. The complainant also craved leave to call for the copy of the policy from the OP. No. 1 at the time of hearing of this case. The copy of the Policy Bond is a vital document which is very much required for the proper adjudication of this case.

Perused the case record and the M.A. case.

It appears that the complainant has already adduced evidence-on-affidavit . Thereafter, she filed this M.A. case which is in hand for passing order.

The OP No.1 in his W/V stated that Paragraphs 1,2 & 3 of the said complaint are the  matters of record and the answering OP No.1 refrains them from dealing with the same.

The policy certificate of the Insurance Policy bearing No. OG-19-1803-1826-00004636 is very essential for proper adjudication of the case . Accordingly, the prayer of the complainant is considered and allowed.

Hence, it is

                                             ORDERED

That the M.A. case being No. 39/2023 is allowed on contest but without any cost.  

The OP No.1 is directed to submit the copy of the Policy Certificate of the Insurance  bearing No. OG-19-1803-1826-00004636 by the date fixed.

The M.A. case is thus disposed of .

Let a copy of this order be given to the parties on free of cost.
