We do not find that this was a fit case to ompose costs on the complainant who was victim of theft in the premises duly insured. While we proceed to dismiss the appeal, we set aside the part of the order which has imposed costs of Rs. 10,000/- to be paid by the Complainant with interest. Although as a rule, costs should follow the event, costs can also be imposed on a prty who succeeds. Considering the facts of this case, this is a fit case to impose costs on the OP/Respondent herein u/s 18 r/w section 14(i) of the C.P. Act. OP to pay Rs. 10,000/- by way of costs to the Appeallant within a period of 30 days or else, it shall carry interest at the rate of 9% until it is paid.
