Final Order / Judgement

Present:       Ms. Gurmeet Kaur complainant in person alongwith counsel Sh. Mandeep Chanana, Advocate.  

                   Sh. Jasvinder Singh, Adv. Cl. for the opposite party nos. 1 & 2.

 

                   Sh. Jasvinder Singh, Adv. Cl. for the OPs/ Bajaj Allianz Gen. Ins. Co.  has suffered a statement that as per the e-mail dated 12th July 2016 received from the OPs/ Bajaj Allianz Gen. Ins. Co., he has been authorized to get the matter in dispute compromised upto the basic sum assured of Rs. 10 lacs only. The company will make the payment in 45 days, if the complainant agree to the above offer.

                   On the other hand, Ms. Gurmeet Kaur, complainant has suffered a statement that she has heard the statement of learned counsel for opposite parties and accept the same as correct. As such, she withdraws the present complaint and the same may kindly be dismissed as withdrawn. However, she reserves his right to claim the said amount alongwith interest, if the opposite parties failed to make the payment within the prescribed period.

                   In view of the above, the present complaint is ordered to be dismissed as withdrawn. Opposite parties are directed to comply with the order as per statement within 45 days from today. Further opposite parties are directed to make the payment to complainant directly. In case of failure, complainant shall be entitled to initiate proceedings under Section 25 and 27 of Consumer Protection Act against opposite parties and in that case complainant shall be entitled to get the claim amount alongwith interest @ 9% p.a. from the date of filing of present complaint till final realization. File be consigned to record room.
