CC No.144 of 2022.

Abhishek Chopra Versus Bajaj Allianz.

 

Present:       None for the complainant.

                                     

                This case has been called several times since morning, but complainant failed to appear before the Commission, either, in person or through any advocate up to 01:00 PM. Further wait is unjustified. Complainant has not done the compliance of order dated 28.03.2022 regarding placing on record Untraced Report of police pertaining to FIR No.79 dated 26.05.2020, Police Station Sadhaura, District Yamuna Nagar and then acceptance of said Untraced Report by the Judicial Magistrate concerned. Both these documents are material documents for the purpose of adjudication of the complaint in hand and non-placing of the same, is a patent defect in the complaint of complainant. Under these circumstances, without commenting anything on the merits of the case of complainant, present complaint is dismissed due to patent defect, as referred hereinbefore, and the complainant shall be at liberty to file afresh complaint, after removing the patent defect i.e. placing on record Untraced Report of police pertaining to FIR No.79 dated 26.05.2020, Police Station Sadhaura, District Yamuna Nagar and then acceptance of said Untraced Report by the Judicial Magistrate concerned. File be consigned to the records.
