Shri Sudip Majumder- President-in-Charge.

Today is fixed for hearing on the petition filed by the complainants dated 27/06/2024 and W/O if any.

Ld. Advocate for both sides are present.

            One application for seeking permission of repair damaged bike has been filed by the complainants dated 27/06/2024. Copy served. The same has been registered as M.A. Case being No. 72/2024. Record is now taken up for hearing.

            Perused the petition. Considered. From the content of the petition it appears that the complainants under take that they will get repair of the bike from the authorized showroom and incur repairing cost of the bike and submit bills before this Commission for assessment of the insurance claim of the bike under the insurance policy being No. OG-23-2401-1826-00041949. Under such circumstances the complainants prayed before us to allow the application and permit to get repair of the bike being regd. No. WB54AC0490 from the authorized showroom and submit the bills before this Commission.

            Heard Ld. Advocates for both sides. No objection raised by the Ld. Advocate for the OP side.

In the instant case, this Commission is of view that if the prayer for permission of repair damaged bike as made by the complainant would be allowed by this Commission that cannot change the nature and character of this case because it is formal in nature.

Hence, the amendment petition being M.A. Case being No. 72/2024 is considered and allowed without contest and without any cost. Complainant is directed to repair of the bike being No. WB54AC0490 from the authorized showroom and submit the bills before this Commission.

Thus the M.A. Case being No. 72/2024 is disposed of.

            Fix. 12/08/2024 for compliance.

Copy of this order be supplied to the parties each at free of cost.
