Final Order / Judgement
During the arguments the counsel for OP has brought to our ntoice that the complainant has not submitted the documents with OP. The counsel for complainant has opposed the plea raised by counsel for OP and argued that the complainant has already sent all the documents alongwith claim form to OP.
We have carefully gone through the record and have considered the rival contentions. 
In the present case, it is noticed that OP has raised objections in Para No.4 of the written version that: if complainant is ready to provide the required documents then the answering insurance company is ready to process the claim subject to terms and conditions of the policy. 
On the other hand in Para No.4 of the complaint, complainant has pleaded that “ he lodged insurance claim with the OP vide claim form dated 3.7.2020 which was sent vide registered number OC-21-1002-6201-00007600 dated 13.6.2020.” Perusal of file reveals that complainant has placed on record the alleged claim form dated 3.7.2020 and the copy of email dated 13.6.2020 which is Exhibit C-25 vide which the claim form was allegedly sent to the OPs. Complainant has further alleged that OP vide letter dated 11.9.2020 sought the documents from the complainant. The complainant complied with the information of OP vide letter dated 28.10.2020. 
It is the specific stand of the OP that complainant has not submitted the documents, as such, claim has not been repudiated till date. We are of the view that complaint is pre mature at this stage. 
 
The counsel for complainant has suffered a statement that all the necessary/required documents for processing the claim of complainant as demanded vide para No.4 of written version of OP, has already supplied to OP. 
Resultantly, complaint is disposed of. In the interest of justice and fair play, and in view of the statement suffered by counsel for complainant we direct to the OP to process the claim of the complainant within 15 days from the date of receipt of the copy of the order. If the claim is repudiated then complainant is at liberty to file a fresh complaint on the same cause of action. Copies of the order be supplied to the parties free of costs under the rules. Counsel for OP is directed to send the copy of the order to the insurance company for compliance. We further direct the counsel for OP to get the copy of the order dasty form this Commission. File be consigned to record.
