ORDER

Both parties file hazira.

The petition dated 28.07.17 filed by the complainant for examination of surveyor of the case is taken up for hearing by treating the petition as Mis. Case No. 32/2017.

The O.P has contested the petition without filing formal objection.

Heard both sides. Objection is raised by O.P.

We find that examination of surveyor is necessary in this case but the complainant has filed the petition at belated stage.

In this juncture prayer is to be allowed with cost.

Hence ordered,

that the petition dated 28.07.17 filed by the complainant for examination of surveyor of the case i.e.  Mis. Case No. 32/2017 is allowed on contest with cost of Rs. 300/- payable by the complainant to the O.P.

Thus MA is disposed of accordingly.
