Perused the material available on record no evidence on affidavit as prescribed under C.P Act.2019 is adduce by the complainant to substantiate his claim .As prescribed under C.P Act 2019 is adduce by the complainant to substantiate his claim . As per sec 38 (6) of C.P Act 2019 every complaint shall be heard by the District Commission on the basis of affidavit and documentary evidence placed on record, thus the onus is on the complainant to prove the allegation made against the O.ps but here the complainant has fail to prove unfair trade practice of the O.P as alleged in his complaint petition. Hence, we are up our opinion that sans merits .Hence dismissed however no order as to cost.
