Heard Mr.Pathode, Advocate for the Applicant/Appellant.  He has filed appeal against the judgement and award passed by the District Consumer Disputes Redressal Forum, Kolhapur, passed in Consumer Complaint No.CC/10/571.  In filing appeal there is delay of 11 days, which we have calculated.  The Appellant has filed Misc. Application No.477/2011 for condonation of delay.  He has made just and sufficient cause for filing the appeal belatedly.  Delay is of 11 days only. Non-applicant/Respondent has been served but he is absent.  He has not contested the condonation of delay application, hence, we are inclined to condone the delay and pass the following order:

O  R  D  E  R

    (i)            Misc.Application No.477/2011 filed for condonation of delay is allowed.

  (ii)            Delay of 11 days in filing the appeal stands condoned subject to cost of `1,000/- to be deposited in legal aid fund of this Commission. 

(iii)            Issue notice before admission to the Respondent in Appeal No.777/2011 by R.P.A.D. at the cost of Appellant through Commission r/o 28/08/2012.  Compliance of this order be made within seven days from today.
