CENTRAL BANK OF INDIA - Complainant(s)

Versus

BABULAL - Opp.Party(s)

ORDER

Shri H.D.Meshram, learned counsel for the appellant.

         Heard on admission.

We have perused the order passed by the District Consumer Forum, Balaghat in case no.49/13 dated 23.10.13, wherein the Forum has very elaborately described the whole situation prevailing in this case awarding a compensation of Rs.15,000/- and cost of Rs.2000/- to the complainant by the appellant Bank.

The facts of the case in brief are that the complainant took loan from the appellant - Bank to purchase two buffaloes.   He got them insured from opposite party no.2 – New India Insurance Co. vide policy no.44313 for a period of three years with tag nos. 53373 and 53364.   On 24.06.12, the buffalo with tag no.53373 died.   The appellant bank sent the wrong tag i.e tag no.53973, instead of tag no.53373, to the O.P.No.2 – Insurance Co.

The Insurance Co. repudiated the claim of the complainant on the ground that the tag number sent by the appellant Bank, was not the same of which claim was made.

The District Forum held the appellant – Bank responsible for the deficiency in service and gave relief to the complainant directing the appellant – Bank to pay compensation alongwith cost of litigation.

We find no adversity or infirmity in the order passed by the District Forum.  The appeal has no merits at all and is therefore, dismissed at the admission stage itself.
