SMT. N. SHAJITHA BEEVI (MEMBER)<br /> <br /> <br /> The complainant K.P. Sudarsanan has filed the complaint before this Forum alleging deficiency in service on the part of the opposite party. The grievance of the complainant is that opposite party is the Registered Trade Union Coconut climber of the complainant. But for the last one and a half year as per request of the complainant the opposite party is not plucking coconuts periodically from the property of the complainant without any genuine reason. The complainant owns several property and that the complainant will get at least one thousand coconuts periodically. Thus the complainant has lost about Rs. 50,000/- by denial of plucking coconuts by the opposite party.<br /> 2. Notice was issued to the opposite party but opposite party not appeared before the Forum. Hence opposite party was set exparte in this proceeding.<br /> 3. On a perusal of the grievance of the complainant, we are of the view that the complainant is not a consumer U/s. 2(1) (d) (ii) of the Consumer Protection Act, 1986. Hence complaint is not maintainable.<br /> In the result, Complaint is dismissed.
