The instant case is taken up for hearing on the point of admission.

Heard the Ld. Advocate appearing for the complainant.

On the face of the record it appears that the complainant filed T.S. no.59 of 2022 in the Court of Ld. Civil Judge, (Junior Division) as Bidhannagar being a suit for declaration and permanent injunction. That apart on behalf of the complainant the copy of complaint of T.S. no.59 of 2022 and relevant copy of application under Order 39 Rule 1 and 2 read with Section 151 C.P.C. relating to T.S. no.59 of 2022 have been filed.

Considering the materials on record and the other disputes of this case it can safely be concluded that the complainant cannot avail opportunities before two Forums that is in the concerned Ld. Civil Court and at the same time before this Commission.

In the above backdrop this Commission is of the view that the instant petition of complaint is liable to be rejected.

Accordingly petition of complaint stands rejected.
