          On 26.9.2016, Sh.Sunny, Store Executive of the opposite party No.1 suffered statement that opposite party No.1 is ready to replace the mobile phone of the complainant with new mobile phone of the same make and model. Further, it is stated that in case of any defect in the mobile phone at any stage, the opposite party No.1 shall replace the mobile phone with new one. In view of the undertaking given by the representative of the opposite party No.1 has withdrawn the instant complaint. Consequently, instant complaint is ordered to be dismissed as withdrawn. Opposite party No.1 shall remain bound by the undertaking given by its representative Mr.Sunny. File be consigned to the record room.
