Present:       Sh.Digvijay Jakhar, Advocate for the complainant.

                   Sh. Kunal Juneja, Advocate for opposite party No.2.

                        Ld. counsel for the opposite party No.2 made a statement that he is ready to pay Rs.37000/- as full and final settlement to the complainant subject to the condition that the handset should not be physically damaged and liquefied. Complainant will hand over the handset alongwith all accessories to the company and the company shall refund the alleged amount within 45 days to the complainant.

                   Ld. counsel for the complainant made a statement that he agrees with the aforesaid statement and requested to disburse the complaint as per the aforesaid statement.

                   In view of the statements made by both the parties, present complaint is disposed of with direction to the opposite party No.2 to refund the amount of Rs.37000/-(Rupees thirty seven thousand only) towards full and final settlement to the complainant within 45 days and complainant shall return the mobile set with accessories to the opposite party no.2. Parties shall be bound by their respective statements.

                   File be consigned to the record room after due compliance.
