Having heard the learned counsel for the appellants and having perused the record, we were of the view that the matter could be disposed of at the stage of admission itself.

The case of the complainant in brief is that he obtained a loan of Rs.40,000/- on10-1-2004  Thereupon he submitted a letter dated25-9-2006  

The appellant bank resisted the case.   25-9-2006 

The complainant in proof of his case filed affidavit evidence and got marked Ex.A1 letter bearing endorsement of the bank. 

The District Forum after considering the evidence placed on record, opined that the very endorsement would disclose that the pension pass book was given to them at the time of granting of loan. 

Aggrieved by the said order, the bank preferred this appeal contending that the District Forum did not appreciate the facts in correct perspective.   

It is undisputed fact that the complainant borrowed a sum of Rs.40,000/- from the bank, on10-1-2004.   Accordingly he gave the said book to the officials of the bank.  25-9-2006

       “ the original P.P.O. could not be located”.

Since the complainant could not get back his pension pass book, he was unable to claim certain emoluments to which he was entitled like revised pay scale, ex-gratia etc. 

               

So far as the direction to return the original pass book is concerned, they contended that it is not possible to obtain a duplicate pass book.   

With this direction the appeal is dismissed at the stage of admission.
