Feeling disturbed by calls received on his mobile at midnight, petitioner having taken recourse to Consumer Grievance Redressal Agency, filed complaint before District Forum, and District Forum finding respondent not deficient in service, dismissed complaint.  Appeal filed by  petitioner before State Commission too was dismissed.  Petitioner who appears in person, has cited certain citations of this Commission in which observations were made that a large number of people are disturbed due to Tele marketing by various Banks and financial institutions.  In this backdrop, the Bank Authorities were directed not to disturb people by unsolicited calls.  Another citation of National Commission that was cited made observation that since unsolicited calls are affecting privacy of a citizen, it should be stopped by financial institutions. 

Having considered the citations which are made available to us, we are of the view that should there be violation of right under Article 21, which is subject to freedom under Article 19 of Constitution, he may take recourse before appropriate Forum for proper  adjudication in the matter.  Dismissed.   Respondent No. 1 however should desist from sending unsolicited calls in odd hour to customers.
