Today is fixed for filing show cause by the complainant as to why this case shall not be dismissed for default.

None appears from the side of the complainant in spite of repeated calls.

The O.P. No.1 and 2 file a petition praying for time on the ground as stated therein.

It is now 04:00 PM.

Cause as per order No. 03 dated 17.08.2016 has not been  shown by the complainant and record shows that the complainant was absent last two occasions including this day without any intimation. The conduct of the complainant shows that he has lost his interest in this case. So, there is no alternative but to dismiss the case.

Hence it is

                           Ordered  

that the case being No.CC-43/2016 be and the same is dismissed for default without cost.

Copies of this order be supplied to the parties free of cost.
