In the present case the petitioner alleges that some unknown person has withdrawn Rs.3000/- from his account and according to petitioner this is a case of forgery/ fraud.

            After appearance the O.ps have filed their written version separately stating that the O.ps are no way liable for the alleges transaction of withdrawal of Rs.30,000/- . As per procedure the amount of Rs.30,000/- has been taken away from her own SBI credit card to some where else account by way of E- Transfer.

            In addition to it the petitioner has stated in the complaint petition vide page-3 that it is the case of fraud.

            In such situation we are in the opinion that the case of cheating / forgery /fraud can not be adjudicated in this commission ,in view of the observation of Hon’ble National Commission reported in 1996(2) CLT-252-N.C ( Satish mehra Vrs. Canara Bank) . Hence the dispute is dismissed with a direction to the petitioner to agitate his grievance in the proper forum i.e Civil Court. No cost.

This order is pronounced in the open Forum on this the 20TH  day of  November,2020. under my hand and seal of the Commission.
