Order below section 36(2) of Consumer Protection Act 2019 in CC/22/132

Heard Complainant in person. Perused Complaint filed by the complainant and document annexed along with complaint at the stage of admission of complaint below section 36(2) of CPAct.

It has been  observed from the perusal of complaint that , complainant being legal heir and son of late mother H D’Souza  one of the co legal owner of F P  888 on the basis of C D No.8040/06  and NOC is issued by opposite party No.2 seeks  to contest the procedure of no redevelopment option and no approved rent to tenants and land owners respectivally authority’s being opposite parties 1 and 2 under service deficiency and unfair  practice of MHADA and MMC Act 88 .It is observing that,complainant is seeking relief  against opposite parties for helpless people abnegated by  Acts and opposite parties Authority  and sought relief that all pagadi tenants of old buildings in suburbs of Mumbai be granted immediattly redevelopment rights and rightful rents after buildings demolished and land owners and opposite party No1,2,3 may be asked to authorize,sanction approve old rented tenants their rightful claims under MHADA and MMC Act Considering averments made in complaint  and provisions of consumer protection Act 2019 this commission  do not have jurisdiction to entertain subjectmatter raised by complainant in complaint   so  we pass order as follows:

                                            ORDER                                          

1)CC No.22/132 is hereby rejected against opposite parties below section 36(2) of Consumer Protection Act 2019

2)No order as to cost.
