ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:
JUDGMENT
Complainant took loan of Rs.7,10,000/- on 19.10.2015 to purchase a car bearing Regd. No.OD-21-C-7070 and the loan was to be paid in 5 years. The complainant being aggrieved by the notice dtd.18.10.2022 for repossession of vehicle has filed the consumer complainant. Period of agreement/contract is already over. As per our order dtd.02.12.2022 the complainant was directed to pay the entire unpaid EMI. But we are not able to know about the pending dues, status of vehicle, loan as both sides are continuously absent.
Relationship between complainant and opposite parties is that of Debtor and Creditor. We find no deficiency in service on the part of opposite parties. Hence we find no merit in the consumer complaint and the same is liable to be dismissed, while parting with the case we observe that if the complainant has paid the entire pending EMIs as per our direction and the loan is still pending then 50% of ODI may be deducted and if the complainant pays the pending dues within 30 days of passing of the order then the same is to be effected and NOC shall be issued within 30 days thereafter. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
