ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                                     JUDGMENT

            In this year old matter judgment was reserved on 16.9.2019 but not pronounced. Notices to both parties were issued and advocates were also informed but none appears.

            The grievance of complainant is that his father availed car loan and there was outstanding for which some goonda persons came to his house for repossession of the vehicle for which complainant approached this Commission and as per order dtd.28.11.2018 complainant was given interim protection. The matter was heard on 28.8.2019 but judgment could not be pronounced by our predecessor for which fresh notice was issued.

            Without entering into any disputed fact we are simply disposing the consumer complaint that the loan was taken by the father of complainant and he is in possession of the vehicle and protected by this Commission since 28.11.2018 and liable to pay the dues. But keeping in view the interest of both parties we direct that complainant shall pay 30% of pending EMIs within 30 days from the date of receipt of order and rest 70% to be paid in 12 installments and in case complainant pays the dues regularly the opposite parties shall be liberal to deduct 50% of additional interest charges. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
