ORDER

This complaint is presented by the complainant against the opposite parties for professional negligence against the opposite parties in conducting tubectomy. The grievance of the complainant is that after she underwent tubectomy with opposite parties she had conceive for a baby, which was unwanted and thereby has sought for awarding compensation for the professional negligence of the opposite parties. The opposite parties have through their advocate contested the complaint by filing version and the complainant is for posted for hearing on merits after parties filed their affidavit evidence and documents. In the course of arguments, settlement was proposed to both parties, considering the nature of the allegation against the opposite parties. The learned counsel representing the complainant submitted if the opposite parties can do another tubectomy free of cost, the complainant do not press the complaint as the complainant do not want any more child and therefore has given that offer. The learned counsel representing the opposite parties agreed and submitted that he will prevail upon opposite parties to do the tobectomy afresh without charging the complainant, for which the learned counsel for the complainant submitted by recording so the complaint may be disposed off. Hence, the complaint is disposed off with an observation that whenever the complainant approaches the opposite parties for undergoing tubectomy, the opposite parties shall do tubectomy without charging the complainant by providing all the necessary medical care and attention. With this, the complaint is disposed off accordingly.
