 No. 34/15.05.2009.

It appears from the record that Decree Holder is not serious about prosecuting the execution case.  Order dated 06.01.2009 shows that the Decree Holder was absent on 16.01.2009.  The Ld. Advocate entered appearance and filed Affidavit that O.P. No. 2 has been arrested.  But he has failed to supply any information in respect of JDRs and the Ld. Advocate wanted opportunity to make an enquiry from the Registrar of Companies as regards the JDR - Company and its Associates/Board of Directors.  On the next i.e. 18.02.2009 Decree Holder does not appear nor take any step.  Same is the position on 09.04.2009 and 04.05.2009.  On the last date 04.05.2009 an order was passed to show cause.  Today neither anyone appear nor step taken nor cause has been shown.  In the circumstances the execution case is dismissed for non-prosecution.
