Per Shri P.N. Kashalkar – Hon’ble Presiding Judicial Member:

In filing this appeal there is delay of 116 days.  For that purpose Misc. Application No.394/2011 has been filed.  In the condonation of delay application in paragraph 6 it has been simply mentioned that since the appellant is 73 years old and not in a position to understand implication of the order in time the delay has occurred.  In appeal it has been mentioned that only and only on account of compulsive circumstances the Appellant could not file the present appeal in time.  It is not the just and sufficient cause so as to condone the delay.  In fact, no cause has been made out to explain the delay of 116 days and therefore, we are not inclined to condone the delay   Hence, the order:

O  R  D  E  R

    (i)            Misc.Application No.394/2011 filed for condonation of delay stands rejected.

  (ii)            Consequently Appeal No.654/2011 does not survive for consideration.

(iii)            Inform the parties accordingly.
