O R D E R

Mr. KRISHNAMURTHY.B.SANGANNANAVAR : JUDICIAL MEMBER

 

1.      This is an Appeal filed u/s 15 of the C. P Act 1986 to set aside the order passed on 30.09.2015 in CC.No.68/2015 by District Consumer Disputes Redressal Forum, Mangalore (for short District Forum/Commission).

 

2. The appeal is filed by OP in CC-68/2015 on the grounds that, the Commission below has failed to appreciate the actual complaint of the complainant, resulting thereby passing of impugned order, which is contrary to facts and law is liable to be set aside.The complainant before the Commission below is guilty of suppression and misrepresentation of facts before the District Commission.The Commission below directed OP to pay Rs.31,000, which according to complainant is a deposit made with the OP for delivery of Eicher Goods Vehicle and to pay Rs.5,000/- as damages and do pay Rs.3,000/- as litigation expenses, within 30 days from the date of receipt of the order and directed to pay interest @ 12% p.a on such amount.

7.      Amount in deposit is directed to be transferred to the District Commission for needful.

 

8.      Send a copy of this Order to the District Commission along with L.C.R.
