ORDER
SRI.P.V. JAYARAJAN, PRESIDENT:
This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration. After hearing the matter the commission passed an order as follows:
- The case of the complainant is that the complainant has purchased a Redmi Phone from the 2nd opposite party on 09/06/2021 using a credit card issued to be complainant by the 1st opposite party Bank. After placing order, the complainant cancelled that order and a request for refund was made to the 2nd opposite party. Though the complainant received the message from the 2nd opposite party stating that the amount has been refunded to the complainant’s bank account the same has not been seen credited to the account of the complainant maintained with the 1st opposite party Bank. Alleging deficiency in service on the part of the opposite parties the complainant approached this Commission for redressal of her grievances. When the case came up today for hearing and appearance of opposite parties, the complainant submitted that the matter is settled. It is also submitted that a memo of settlement is also filed before this Commission. The above said memo of settlement is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.
- In the result the complaint is dismissed as settled. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the Open Court, this the 01st day of November, 2021.
