ORDER

Heard. Vide impugned order, the complaint filed by the appellant before the State Commission was dismissed in default due to non appearance. It would be pertinent to point out that proxy counsel on behalf of respondent no.4 was present on that date. Authorised representative of the respondent no.4 states that there is no objection if the impugned order passed by the State Commission is set aside, subject to payment of heavy cost and matter is remanded back to the State Commission to decide the matter afresh in accordance with law. In view of no objection given by authorized representative of respondent no.4, the present revision petition is allowed, subject to payment of Rs.10,000/- (Rupees Ten Thousand only) as cost and the matter is remanded back to the State Commission to decide the same afresh in accordance with law. The appellant is directed to remit the cost by way of demand draft in the name of respondent no.4 directly, within four weeks. In case appellant fails to comply with the above directions within the specified period, then the appeal shall stand dismissed automatically without any further order. With these observations, present appeal stands disposed of. Parties are directed to appear before the State Commission on 7.7.2014. Meanwhile, the State Commission shall make an endeavor to decide the matter preferably within one year, from the date of receipt of the order. Dasti to both the parties.
