This a complaint filed under Section 35 of the Consumer Protection Act, 2019 alleging deficiency of service on the part of the opposite parties and seeking to realise an amount of Rs. 3,65,213/- towards hospital expenses and compensation of Rs. 3,00,000/-.
2. The opposite parties have filed written version denying all allegations and claims made in the complaint.
3. The case is posted for the affidavit of the complainant as last chance today. The complainant is absent and there is no representation. The complainant is continuously absent. The onus is on the complainant to prove the allegations. But the allegations are not proved. The complainant is continuously absent and it appears that he is not interested in pursuing the matter.
In the result, the complaint is dismissed. No order as to costs.
