1. Heard Ms Rashmi Sharma, the Appellant who is present in person.
2. Contention of the Appellant is that the complaint filed by her in District Forum (III), Janak Puri, New Delhi was dismissed in default on 04.07.2014.
3. The reason for the absence of the appellant on the relevant day was that her husband had undergone a minor operation on 13th June, 2014 and thereafter he was admitted to a hospital for treatment of infection. After being discharged he again got fever and on Ist July, 2014 his condition became serious. On July 7, 2014 he was shifted to ICU and on 9th July, 2014 he expired. In the circumstances and in the interest of justice, appeal is allowed setting aside the dismissal orders dated 04.07.14. Case is remanded back to District Forum (III), Janak Puri, New Delhi with a direction to restore the complaint to its original number, and proceed in the case in accordance with law. The Appellant/ Complainant is directed to appear before the District Forum (III), Janak Puri, New Delhi on 27.1.15.
