            Record is put up for order on the point of admission.

            The matter was heard on 10.03.2021.

            Perused  the consumer complaint coupled with documents annexed thereto. On perusal of the consumer complaint it appears that complainant and OPs 1 & 2 are residing as well as carrying on business outside the territorial jurisdiction of this Commission. Complainant implicated OP- 3 Nodal Officer of Axis Bank Limited to create jurisdiction of this Commission.

                        Facts remains that the complainant has a Savings Bank A/c with OP-1 at its Barisha Branch and the OP-2 being the Manager of OP-1 is dealing with day to day business affairs of OP-1. The OP-3 has no connection with the allegation of the complainant. To create jurisdiction the complainant implicated OP – 3 in this case. Therefore, it is crystal that the complainant has bypassed the jurisdiction. The complainant maintaining SB A/c at Barisha Branch of Axis Bank Ltd.Thus, this Commission has no territorial jurisdiction to entertain the complaint.

As a result, the consumer complaint is not admitted and dismissed in limini.  Hence,

Ordered.

            That the consumer complaint is not admitted and dismissed in limini on the ground of jurisdiction point.

            In view of dismissal of the complaint Miscellaneous Application is not tenable and rejected. Thus MA being No. 83 of 2021 is disposed of.
