ORDER

Date of order:  30-03-2017

S.K.Sinha,President

The complaint is filed claiming compensation of Rs. 99,99,000/- (Rupees ninety nine lacs and ninety nine thousand only) for the alleged defective and deficient services of the O.P.-Bank causing mental, physical, economic loss and also for pain suffered by the complainant.

2.                          The complainant basically alleged that Bank did not provide the services which should had been given, since the Saving Bank account in question opened by the Bank in favour of the complainant was a “Priority Account”. This apart Bank deducted some amounts ranging between Rs, 191/- to 862.50/- in between 16-06-2012 to 14-06-2016. On making complaint for the aforesaid charges a sum of Rs. 682.50/- was only deposited back in his above account. The complainant allegedly had deposited a cheque of Rs. 5,00,000/-(Rupees five lacs only) .However, the said cheques was dishonored  by paying Bank on being sent for collection due to  in sufficient fund, but said cheque was not returned back so that complainant could have prosecuted and recovered twice the value of cheque amount. There are some other allegations that an excess amount of Rs. 15,636/- in the complainant’s credit card account with the Bank which was not refunded despite promise of the Bank.

3.                          We have considered the submissions on behalf of the complainant as also perused of the complaint. We find that there are complete back of fundamental facts from where it                                                                                      could have disclosed any justification for claiming such a huge compensation of Rs. 99, 99,000/-(Rupees ninety nine lacs and ninety nine thousand only). The same appears to be an  imaginary claim made purposely so, that this may be filed in the State Commission as claims less than  Rs.20,00,000/-(Rupees twenty lacs only)  lies before District Forum.

4.                          The complaint as such is not maintainable before this Commission. It is accordingly dismissed. It is made clear that we have not gone in to merits of the claim.
