None appeared on behalf of the complainant.  On the previous date learned counsel for the opposite party No. 2 has filed an application under Order 1 Rule 10(2) read with Section 151 of the CPC. Today the case fixed for filing reply to the application.  Case called several time since morning.  It is 4.00 p.m. neither the complainant appeared through Video Conference nor physically to file reply to the application. On the perusal of the file shows that the complainant is not appearing for last 9 dates.  It appeared that the complainant is not interested to pursue the present complaint. Therefore, the case is dismissed in default.  Copy of the order be supplied to the parties, free of costs as per rules. File be consigned to records after its due compliance.
