The complainant/Appellant approached this Commission against the order passed by the District Commission which dismissed against the respondent company and submits that he had taken one insurance policy from the Opposite Party and subsequently he sought for refund of the entire policy amount to the tune of Rs.1,80,000/- along with damages of 50,000/-.

The District Commission after noticing that the policy amount was paid after surrender after deducting surrender charges under the head of surrender and dismissed the complaint.

We are of the opinion that, when the policy was surrendered and surrendered amount was paid to the complainant, the question of payment of policy assured amount or entire premium amount does not exists. The complainant not appeared before this Commission to submit any supportive arguments in support of his claim. He is continuously absent, no reasons explained to set aside the order. As such the appeal is dismissed.
