AWARD

1.        Case taken up today in Upbhokta Lok Adalat. The parties have settled the matter. Statement of Sh.Sandeep Suri, Counsel for OP No.3 has been recorded separately in which he has stated that OP No.3 created a lien in the account in question and in the said account, the said money has been transferred by Aviva Life Insurance (OP No.1 & 2) and OP No.3 has no objection in case the amount in question alongwith interest accrued thereon, if any, be transferred in the account of the complainant regarding which OP No.1 & 2 had also earlier requested to the OP No.3 Bank as well as if OP No.1 & 2 Aviva Life Insurance made no objection in transfer and the amount shall be paid within four weeks from the date of receipt of the order.

2.        Vide his separate statement, Sh.Mayur Kanwar, Counsel for OP No.1 & 2 has stated that OP No.1 & 2 have no objection if the amount lying with OP No.3 Bank is disbursed to the complainant in his account number details of which have been given by the complainant before this Commission on 05.12.2022, the details of which are “Account Holder Pankaj Kaushal, Account No.827423846, IFSC Code IDIB000S161, Indian Bank, Sector 21, Panchkula”. Further stated that payments in future, if any, will only be deposited by OP No.1 & 2 in the above mentioned account of the complainant.

3.        Vide his separate statement, Sh.Sunil Narang, Counsel for complainant has admitted the above statements of Sh.Sandeep Suri, Counsel for OP No.3 & Sh.Mayur Kanwar, Counsel for OP No.1 & 2 and prayed for passing of award.

4.        In view of the statements of the parties, OP No.3 is directed to transfer the amount in question with accrued interest in the following account of the complainant within four weeks from the date of receipt of the order;

5.        The award is accordingly passed.
