ORDER

1.        This is an application filed on behalf of applicant/OP for refunding the amount of Rs.11,53,834/-which was deposited by them before this Forum in the execution application, which was stayed by the Hon’ble National Commission vide order dated 20.08.2009. It has been alleged that the complaint filed by the complainant was allowed by this Forum. The appeal filed by the OP was dismissed by the Hon’ble State Commission. The Hon’ble National Commission vide its order dated 21.11.2014 accepted the revision petition filed by the applicant/OP and dismissed the complaint filed by complainant. Hence the present application for refund of the amount  

2.        Notice of the application was sent to the complainant, but she has not turned up to oppose or contest the application.

3.        We have heard the counsel for applicant/OP and gone through the record. As per office report, an amount of Rs.11,53,834/- has been deposited vide order dated 12.08.2009 passed in CP No.100/2009. Office has further reported that no stay order has been received from any other report. There does not seem to be any impediment in releasing the amount of Rs.11,53,834/- to the applicant/OP with accrued interest. Hence, the same is ordered to be released to the applicant/OP namely Aviva Life Insurance Company India Limited with accrued interest thereon. Office to take necessary action for release of the amount. This miscellaneous application stands disposed off and it be tagged with the main file. A copy of this order be also placed on record the execution application file, if any.

4.        Certified copies of this order be sent to the parties free of cost.
