MRS. SUSMITA MISHRA, PRESEIDENT:-
The Complainant has filed the C.C.Case No. 174/2023 U/s-35 of C.P.Act, 2019 seeking the following relief:
“ After hearing the both parties the Hon’ble Commission directed to the Ops to file a show cause regarding to settle the loan amount in one time settlement scheme. Further directed to the Ops to pay Rs. 3,20,000/- towards compensation of loss of business, mental agony & litigation cost
Final award under Arbitration and Conciliation Act-1996 has been passed on 21.10.2021 i.e, much prior to filing of this case before this Commission on dt. 14.11.2023. As such the consumer complainant is not maintainable.
Counsel for Complainant submitted that Petitioner wants to settle the loan in OTS and he has already filed an application on dt. 21.08.2023 before the Op to settle the same in OTS. However taking a lenient view we direct the Op to consider the OTS application sympathetically in accordance with Rules.
With the aforesaid observation and direction the C.C.Case No. 174/2023 is accordingly disposed off. No order as to cost.
