            This case is put up today for hearing on the set-aside petition filed by the Opposite Parties on dated 7.4.2014. The set-aside petition is not served to other side because the complainant is absent since 8.8.2013 to 26.9.2016. Neither the complainant nor his Advocate present today. The advocate for the O.Ps is present today. This is a year old case belongs to the year 2013. On perusal of case record it is found that the complainant was absent and not filed any steps from 9.9.2013 to 26.9.2016.  This Forum served notice to the complainant through Registered Post vide this office L.No. 490 dated 8.7.2016 but returned unserved with postal remark “Addressee left without information, hence returned to sender”.  So we feel that the complainant is not interested to proceed with his case. The complainant failed to perform his obligatory duty to remain present at the time of hearing as required under Rule 4 Sub Rule 8 of the Odisha Consumer Protection Rules, 1987.

            In the result, we dismissed the complaint for default of appearance.

            The order is pronounced on this day of 1^st November 2016 under the signature and seal of this Forum. Copy of order be supplied to the parties free of cost. Copy of the order be sent to server www.confonet.nic.in. Thereafter the file be consigned to record room.
