            In nutshell the grievance of complainant Abdul Khader is that inspite of the 7 free services offered at the time of purchase the opposite party charged `384/-  including 180/- towards service charges when he took his Honda Activa two wheeler for its 5th service.

2.            According to opposite party the manufacturer of the vehicle is providing only 4 free services and those services were already availed by the complainant.

3.            Complainant and the counsel for opposite party is heard.  Ext.A1 is marked on the side of complainant.  Exts B1 & B2 marked on the side of opposite party.  Ext.A1 is a plastic envelop on the rear side of the envelop the service  schedule of Honda Activa is printed.  As per the said schedule7th free service is to be done in between the 23500-2400 KMS running the vehicle or in between 715-735 days Relying on these cover issued by opposite party, the dealer of Honda Activa Scooter the complainant pleaded that opposite party offered 7 free services.

4.         On the contrary, opposite party’s counsel submitted that the Honda Company who is the manufacturer of the vehicle is now providing 4 free services only.    According to him formerly they were offering 7 free services.  To substantiate this contention Ext.B2 an Owner’s Manual printed by the manufacturer of the vehicle Honda Motor India Ltd is produced.  On perusal it is seen that only 4 free service coupons are contained in the owner’s manual.  The counsel for opposite party further submitted that Ext.A1 the plastic cover is printed earlier when the manufacturer was offering 7 free services.

5.         On enquiry complainant submitted that except the printing on the plastic envelop which is given at the time of purchase, opposite party not represented him that they are providing 7 free  services for Honda Activa two wheeler.

6.         In the said circumstances it cannot be hold that opposite party has offered 7 free services and thereby committed unfair trade practice or deficiency in the service rendered by them to opposite party. The complainant is therefore liable to pay service charges from 5th service onwards.

            The complaint therefore fails and accordingly it is dismissed with no order as to costs.
