The complainant was directed to show cause today as to why his case will not be dismissed for default.

But the complainant is absent without steps and no show cause is filed by him. He has not also discharged the liability for filing requisites for issue of notice to the OPs. It seems to us that the complainant has lost interest to proceed with the case and it is next to impossible for the case to run the case with the repeated absence or reluctance of the complainant. We think it is a fit case where a dismissal order should be recorded to avoid the abuse of process of the court proceedings.

Hence it is ordered that the case be and the same is dismissed for non-prosecution: but without cost.

Let a plain copy be given to the parties free of cost as per CPR.
