1. The case of the Complainant is that the Complainant ordered Steel materials to the OP on 19.01.2024 and the OP noted down on the list and its total price is amounting of Rs. 21,277/- and thereafter on dt. 01.02.2024, the Complainant again placed order to the OP and the OP noted down the names of the Steel materials on a plain paper along with its prices amounting of Rs. 20,110/- and further the Complainant placed order on dt. 16.02.2024 to the OP and the OP supplied directly amounting to Rs. 5,625/- and this time without noting down on a paper and in this way the Complainant purchased the total amount of Rs. 47,012/- of Steel materials for making Doors and windows of Kshitish English medium School Room. In spite of several requests for the supplying the bills, lastly the OP have given one forgery Bill of Laxmi Enterprises, situated at Shop No. 3, jail Road in front of Labour office, Sambalpur to Kshitish English Medium School with a total amounting of Rs. 47,012/- without mentioning each order of the Steel Materials and instead of giving separate Bills of each dates. In that Bill the OP has taken S.G.S.T and C.G.S.T amounting to Rs. 3586+Rs. 3586= Rs. 7172/- from the Complainant though the Complainant has purchased many items of Steel Materials from the OP. on different dates. When the Complainant requested the Op to supply three numbers of Bills of New Laxmi Enterprises situated at Kuluthkani Road, Sambalpur, by mentioning the names of each & every articles of steel material that the Complainant placed order, but the Op refused to give any Bill of New Laxmi Enterprises. The Complainant served a legal Notice on 20.06.2024 to the OP but the OP did not receive the said notice and refused the same. Hence, this case.
2. The OP is set-exparte as he is not given his version in time.
3. From the records and evidences, it is observed that after several request from the Complainant to the OP, the OP did not give actual Bills, which amount to deficiency in service and unfair trade practice on the part of the OP. Accordingly it is ordered.

ORDER

The case is disposed of on merit. The O.P is directed to provide genuine Bills of the New Laxmi Enterprises mentioning separately actual showing date of purchase within one month of the receipt of the order, Rs. 1, 00,000/- towards harassment and mental agony suffered by the Complainant as compensation and Rs. 10,000/- towards litigation expenses within 30 days from the date of receipt of the order, failing which the amount will further carry with 9% interest per annum till realization to the complainant.

Order pronounced in the open Court today on 4^th day of Nov, 2024.
