None has responded on behalf of the appellant inspite of several calls.

As per the previous order, the appellant has not submitted copy of the newspaper “Dainik Bhaskar”, so as to ascertain whether the said newspaper is published and circulated daily at a large scale in the town of Gwalior, Madhya Pradesh or not, so that service of notice upon respondent may be effected through publication in the said newspaper.

Thus, the appellant has not complied the order passed by this Commission.

It appears that the appellant is not interested to continue the appeal and is reluctant to proceed further in the matter.

In such circumstances, the Commission has no other option except to dismiss the appeal.

Accordingly, the appeal is dismissed in the absence of appellant as well as for want of prosecution.  No order as to costs.

File be consigned to the record room along with copy of this order.

A copy of this order be sent to the concerned District Commission for perusal, information and necessary action.  The original record of the District Commission be also remitted back forthwith.
