Both parties are present by filling hazira through their Ld. Agents.

The Complainant is absent on call. The Ld. Agent for the Complainant files a verified petition praying for dismissing the case on the ground that the case has been compromised.

The case is taken up for order on the petition dated 13/04/2007 filed by the O.P. No.1 praying for vacating the Ex-parte order on the ground as stated therein.

Seen the petition and papers and allowed.

The Ex-parte order against the O.P. No.1 stands vacated.

Heard the Ld. Agent for the Complainant and the O.P. No.1 and on the petition filed by the Complainant for withdrawal of the case.

The Ld. Agent for the Complainant has submitted that the Complainant has compromised the matter and is not willing to proceed with the case.

The Ld. Agent for the O.Ps have submitted that the case may be dismissed.

The petition filed today is duly verified and the Ld. Agent for the Complainant has identified the signature of the Complainant.

In this circumstances, it is useless to proceed and to drag the case and the petition should be allowed.

The verified petition filed today by the Complainant is considered and allowed.

                                That the case be and the same is dismissed for non-prosecution.
