मध्‍य मुंबई ग्राहक तक्रार न्‍याय निवारण मंच, परेल मुंबई दरखास्‍त क्रमांक – 11/2011 दरखास्‍त दाखल दिनांक – 22/03/2011 आदेश दिनांक - 21/06/2011 श्री. यादव रामदास फलक, सौ. मंजुळा यादव फलक, बी-204, मेघ मल्‍हार को.ऑप.हौ.सो.लि., दिंडोशी बस डेपोच्‍या मागे, मालाड (पूर्व), मुंबई 400 097. . ........ अर्जदार/मूळ तक्रारदार विरुध्‍द अष्‍टभूजा नागरी सहकारी पतसंस्‍था मर्यादित, (फॉर्मर्ली नोन अँज भूदरगड तालुका को.ऑ.क्रेडिट सोसायटी लि., 2/2, मोहमदी बिल्‍डींग, डॉ. आंबेडकर रोड, लालबाग, मुंबई 400 012. ......... गैरअर्जदार/मूळ सामनेवाले समक्ष – मा. अध्‍यक्ष, श्री. नलिन मजिठिया मा. सदस्‍या, श्रीमती भावना पिसाळ उपस्थिती – तक्रारदार व त्‍यांचे वकील योगिता बडेकर हजर गैरअर्जदार व त्‍यांचे वकील महेश जोशी हजर - आदेश - - द्वारा - मा. अध्‍यक्ष, श्री. नलिन मजिठिया प्रस्‍तुत दरखास्‍त अर्ज अर्जदार यांनी ग्राहक संरक्षण कायद्याचे कलम 25(3) प्रमाणे दाखल केलेली आहे, व त्‍यांनी नमूद केले आहे की, मंचाने तक्रार क्रमांक 139/2008 मध्‍ये दिनांक 31/08/2009 रोजी आदेश पारित केला आहे. गैरअर्जदार ही सहकारी पतपेढी असून त्‍यांच्‍याकडे तक्रारदार यांनी रक्‍कम गुंतवली होती. तक्रारदार यांनी सदर रक्‍कम गैरअर्जदाराकडून वसूल करण्‍यासाठी वसूली प्रमाणपत्र मागितलेले आहे. 2) गैरअर्जदार यांना मंचामार्फत नोटीस पाठविण्‍यात आली होती. त्‍यांनी त्‍यांचे म्‍हणणे दाखल केले आहे. प्रस्‍तुत दरखास्‍त मंचासमक्ष दिनांक 21/06/2011 रोजी सुनावणीसाठी आली असता तक्रारदारातर्फे वकील योगीता बेडेकर हजर होत्या, गैरअर्जदारातर्फे वकील श्री. महेश जोशी हजर होते. उभयपक्षांची सुनावणी घेण्‍यात आली. 3) तक्रारदार यांनी प्रस्‍तुत दरखास्‍तीसोबत मंचाने मूळ तक्रार क्रमांक 139/2008 मध्‍ये दिनांक 31/08/2009 रोजी पारित केलेल्‍या आदेशाची छायांकित प्रत दाखल केलेली आहे त्‍यात माझे पूर्व अध्‍यक्ष यांनी खालीलप्रमाणे अंतिम आदेश पारित केलेला आहे - O R D E R The Complaint bearing No. CMDF/CC/139/2008 is partly allowed in the following terms : 1. The Opponent is directed to pay to the Complainant No. 1 the principal amount of Rs. 60,000 (Rs.Sixty Thousand only) of F.D. No. 35. 2. The Complainant No.1 and Opponent to calculate the interest on this principal amount of Rs. 60,000 (Rs. Sixty Thousand only) a) @ 16% p.a.for the period from 7.12.01 to 7.12.04 b) @ 9 % p.a. for the period from 8.12.04 till the date of realization. 3. The Opponent to deduct Rs. 47,100/- (Rs. Forty Seven Thousand One Hundred only) the amount of interest already received by the Complainant of F.D. No. 35 as shown in Exh. A to the complaint, from the total amount of interest i.e. @ + (b) above and to pay balance interest, if any, to the Complainant No. 1. 4. The Opponent is directed to pay to the Complainant No. 1 principal amount of Rs. 60,000/-( Rs. Sixty Thousand only) of F.D. No. 50. 5. The Complainant No.1 and Opponent to calculate the interest on this principal amount of Rs. 60,000/-( Rs. Sixty Thousand only) a. @ Rs. 15% p.a. for the period from 29.4.02 to 29.4.07 b. @ Rs. 9% p.a. for the period from 30.4.07 till the date of realization. c. Opponent to deduct Rs. 40,800/- (Rs. Forty Thousand Eight Hundred only), the amount of interest already received by the Complainant No.2 of F.D.No. 50 as shown in Exh. A to the complaint from the total amount of interest i.e. a) + b) above and to pay the balance interest, if any,to the Complainant No.1. 6. The Opponent is directed to pay to the Complainant No. 2 the principal amount of Rs. 60,000/-/-( Rs. Sixty Thousand only) of F.D. No. 36. 7. The Complainant No.2 and Opponent to calculate the interest on this principal amount of Rs. 60,000/-/-( Rs. Sixty Thousand only) a. @ 16% p.a. for the period from 7.12.01 to 7.12.04 b. @ 9 % p.a. for the period from 8.12.04 till the date of realization. 8. The Opponent to deduct Rs. 47,100/- ( Rs. Forty Seven Thousand One Hundred only) , the amount of interest already received by the Complainant of F.D.No. 36 as shown in the Exh.A to the complaint from the total amount of interest i.e. a) + b) above and to pay balance interest, if any, to the Complainant No. 2. 9. The Opponent is directed to pay to the Complainant No. 2 principal amount of Rs. 60,000/- (Rs. Sixty Thousand only) of F.D. NO. 51. 10.The Complainant No.2 and Opponent to calculate the interest on this principal amount of Rs. 60,000/- (Rs. Sixty Thousand only) a. @ 15% p.a. for period from 29.4.02 to 29.4.07 b. @ 9% p.a. from 30.4.07 till the date of realization. 11.The Opponent to deduct the amount of Rs. 40,800/- (Rs. Forty Thousand Eight Hundred only), the amount of interest already received by the Complainant of F.D. No. 51 as shown in Exh. A to the complaint , from the total amount of interest i.e. a) + b) above and to pay balance amount, if any, to the Complainant No. 2. 12.The Opponent is directed to pay to the Complainant No. 2 the principal amount of Rs. 50,000/- (Rs. Fifty Thousand only) of F.D. No. 94. 13.The Complainant and Opponent to calculate the interest on this principal amount of Rs. 50,000/- (Rs. Fifty Thousand only) a. @ 15% p.a. from the period from 8.1.03 to 8.1.06 b. @ 9% p.a. from 9.1.06 till the date of realization. 14.The Opponent to deduct Rs. 1,14,912/- (Rs. One Lakh Fourteen Thousand Nine Hundred Twelve only), the amount of interest received by the Complainant of F.D. No. 94 as shown in Exh. A to the complaint from the amount of interest a) + b) and to pay the balance amount of interest, if any, to the Complainant No. 2. 15.The Opponent is directed to pay Rs. 5000/- to the Complainants towards mental agony. 16.The Opponent is directed to pay to the Complainants Rs. 3000/- towards the cost of this proceeding. गैरअर्जदार यांनी सदर आदेशान्‍वीत रक्‍कम तक्रारदार यांना दिलेली नाही व आदेशाची अमंलबजावणी केलेली नाही. त्‍यामुळे ग्राहक संरक्षण कायद्याचे कलम 25(3) प्रमाणे मंचाला गैरअर्जदाराविरुध्‍द वसूली प्रमाणपत्र देण्‍याचे अधिकार आहेत. त्‍यामुळे मंच खालीलप्रमाणे आदेश पारित करीत आहेत. - आदेश - 1) प्रस्‍तुत दरखास्‍त क्रमांक 11/2011 मंजूर करण्‍यात येते. 2) प्रबंधक यांनी आदेशात नमूद केल्‍याप्रमाणे तक्रारदार यांना ग्राहक संरक्षण कायद्याचे कलम 25(3) प्रमाणे वसूली प्रमाणपत्र द्यावे. 3) प्रस्‍तुत दरखास्‍तीचा खर्च रुपये 500/- (रुपये पाचशे फक्‍त) गैरअर्जदार यांनी तक्रारदाराला द्यावा. 4) सदर आदेशाची प्रत नियमाप्रमाणे उभयपक्षांना पाठविण्‍यात यावी. दिनांक – 21/06/2011 ठिकाण - मध्‍य मुंबई, परेल. सही/- सही/- (भावना पिसाळ) (नलिन मजिठिया) सदस्‍या अध्‍यक्ष मध्‍य मुंबई ग्राहक तक्रार न्‍याय निवारण मंच, परेल मुंबई एम.एम.टी./-
