ORDER

Smt. C.S. Sulekha Beevi, President 1. The case of the Complainant is that he is the tenant of the shoproom to which electrical connection with consumer number T/3493 is provided by opposite party No.1 and opposite party No.2. Opposite party No.3 is the landlord of the building. The electricity meter which was installed under the staircase of the building was found to be stolen on 10-10-2002. Complainant lodged a complaint before opposite party No.1. He requested opposite party No.1 to instal a new meter, but his request was not heeded. He had to hire generator for supply of electricity. On 22-10-2002 he remitted Rs.,1,178/- as charges for installing new meter. On 23-10-2002 new meter was installed and supply was restored. He is aggrieved that opposite parties did not take sufficient care of the meter installed in his premises. He alleges deficiency of service and prays for refund of the amount and expenses for hiring generator. 2. 1st and 2nd opposite party have filed joint version. They contend that the consumer has to make arrangements for safety of the meter. It is the consumer who is liable for any damage or loss caused to the meter installed in his premises. Opposite parties have installed the new meter as soon as the amount was remitted. There is no deficiency of service and complaint is liable to be dismissed. Opposite party No.3 has filed version that he is not intimated about the theft of the meter. That complainanthas not oldged any police complaint. That the apparatus placed in the premises is the property of Kerala State Electricity Board and 1st and 2nd opposite parties are responsible for its' safety and maintenance. That complainant is liable to compensat the Board if loss is caused to the Board due to neglect of complainant. 3. No documentary or oral evidence is adduced on either side. Heard both sides. The points that arise for consideration are (i) Whether there is deficiency of service on the part of opposite parties. (ii) Reliefs and costs. 4. The complainant is aggrieved that the electricity meter was found stolen on 10-10-2002. He has not produced any evidence to prove loss/theft of the meter. Complainant is the tenant/beneficiary of the electrical connection. The agreement for supply of electricity was entered into by opposite party No.1 and opposite party No.3 who is the landlord. The conditions for safety and meintanance of the meter are stated in the agreement. The agreement is not produced by either side. Opposite party No.1 has fixed the new meter and restored electric supply as soon as charges were remitted. Opposite party No.3 has not been intimated about the theft of electric meter at all. Complainant has failed to prove any case in his favour. We hold that there is no deficiency of service on the part of opposite parties. 5. In the result, we dismiss the complaint with no order as to costs. Dated this 7th day of November, 2007. C.S.
