            The petitioner has filed the present dispute alleging deficiency in service on the part of the o.ps.

            The fact of the complaint  petition in short is that the petitioner is a domestic consumer bearing consumer No.6152-5105-1543 before the O.P .The petitioner is stating  that she has paid the electricity  dues regularly as per bill submitted by the O.P  and even in  pendamic  period of covid-19 from March- 2020 till the date of filing of the present dispute the petitioner has  paid all the outstanding dues as demanded by the O.P  .Further  the petitioner has stated that by virtue of spot verification by the O.Ps  on 21.12.19 the O.P  has claimed  arrear amount of Rs70,209.01 as energy charges . That in the monthly amount of energy charges paid by the petitioner  regularly no arrear amount pending against the consumer No. 6152-5105-1543   and how suddenly the above arrear amount claimed by the O.P. The petitioner also stated  that he is a innocent person and facing  mental agony for the above activity of the O.P . The petitioner  also requested   the O.P to   replace a new  old meter and corrected the illegal arrear charges but  the O.P  is paying  deaf ear to the request of the petitioner. Finding no other alternative the petitioner  knocked the door of this commission in filing  this dispute with the prayer  waive out  the illegal claim of the arrear amount of Rs. 70,209.01/-   as well as compensate him a sum of Rs20,000/-  for mental agony and  harassment and cost of proceeding.

            The notice of the present dispute duly served on the O.Ps    but the O.P did not choose to file any written version  or objection  against the petition  filed by the petitioner. Hence  this commission has set exparte   the O.P  vide order dt .18.02.21 .

On the date of hearing the petitioner himself is present  and heard the argument from the side of the petitioner  .

 

Hence finding no other alternative this  commission is bound to accept the uncontroverted  statement   mentioned in the complaint petition  as per observation  of Hon’ble Odisha  State Commission reported in 2003-CLT-Vol-96-p-15 .C.D.Case No.37/02  wherein it is held that:

“In absence of written version by the O.P, the  Commission is bound to accept the uncontroverted statement of the complaint petition.

And

2013(1)CPR-507-N.C ,wherein  it is held that:-

In case written version not filed after several opportunity,       it has no defence on merit.”

Hence this order  

            The dispute is allowed against the O.P as exparte. The arrear claimed  amounting to Rs.70,209.01/- as claimed by the O.P  against the consumer no. 6152-5105-1543(Domestic)  is hereby quashed  . No cost.

This order is pronounced in the open Forum on this the 30th  day of  June,2021. under my hand and seal of the Commission .
