This complaint has been filed by the complainant u/s 12 of C. P. Act, 1986 praying for getting his sum of Rs.27670/- alongwith interest from the E.P. Fund along with Rs.40000/- as compensation and Rs.10000/- for mental pain and agony due to non-encashment of cheque for Rs.27670/- from the OPs.
By filing a petition dt. 29.11.2017 the complainant wants to withdraw the case as the Opposite Parties transferred the amount of Rs. 29198/- on 15.11.2017 in his bank account. So, the complainant has no grievance against the Opposite Parties.
Heard. Perused the case record as well as the petition for withdrawing the case.
Having gone through the same we are of view that the dispute between the complainant and the OPs have been settled. The complainant has got his claimed amount alongwith interest. He has no other grievance against the Opposite Parties. He is willing to withdraw the case. So the Forum should not stand on the way of the pious wishes of the complainant.
Hence,
Ordered
that the Consumer Complaint No. 136/2017 be and the same stands disposed of being withdrawn.
There will be no order as to cost.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
