MR. PRABODHA KUMAR DASH, PRESIDENT:-           

         This is an application U/S-35 of C.P.Act,2019 alongwith  on I.A No. 14/2021 as per Sec-38(8) of C.P.Act wherein the Complainant Gura Mahali, W/o- Late Birabara Mahali alleged that after demise of her husband the family pension being deposited in OpNo.3’s A/c instead of Complainant’s A/C and accordingly an order in IA No. 14/2021 dt. 22.06.22 passed by this Commission where it was directed not to pay  any body particularly to OpNo.2 any payment for the A/C No. 30178081949 till disposal of IA No. 14/2021 as well as C.C.Case No. 32/2021. The same order communicated to Ops and OpNo.1(Bank) in their written version dt. 07.07.2022 stated therein the deceased pensioner Account no was 30301107983 bearing PPO No. 330911 and the pension was in this account till his death January-2020 which was stopped from 27/02/2020 due to death  and his wife(Complainant) not taken any steps for family pension and the same not initiated till date and no such pension ever received in A/C No. 30178081949 in name of OpNo.2. the Op No.1 Bank further stated after demise of pensioner no family pension initiated in favour of Complainant for non-application of the Complainant before authorities  to grant family pension.

O R D E R

                     It is directed that, the Complainant shall visit Home Branch with death certificate of her deceased husband, KYC, Documents, Photo deposit the same then the Home Branch is to start her family pension. Ld. Advocate Bibhu Pr. Singh, Suresh Ch. Nayak communicate the order to the Complainant so that the Complainant can take appropriate steps for release of the family pension in her favour. On the above advice and observation the C.C.Case No. 32/2021 alongwith I.A. No. 14/21are accordingly disposed off.

                      Issue extract of the order to the parties for compliance.
