Both sides represented by counsels. Opposite party produced the order in the appeal filed by complainant before Deputy Chief Engineer under Sec.127(1) of Indian Electricity Act. As per the decision rendered in 2008 CTJ 853(CP) NCDRC the Apex Commission has held that the consumer can opt either to file appeal under Sec.127 of Indian Electricity Act or to file complaint under the Consumer Protection Act. The complainant has already availed the remedy of filing appeal under


 


 

Sec.127(1). This is admitted by the complainant in the complaint. Hence complaint not maintainable. Complaint dismissed. No costs.
