IA/13584/2024(Early Hearing) Heard Learned counsel for the applicant and perused the application seeking early hearing. Considering the submissions made in the application seeking early hearing, the same is allowed. Case is taken up for hearing today itself. SECOND APPEAL NO. 9 OF 2022 Learned counsel for the petitioner submits, on instructions, that the petitioner wishes to withdraw its second appeal with liberty to file revision petition in its place and may be permitted to do so. In view of the submissions made, the second appeal stands dismissed as not pressed. The petitioner is at liberty to file revision petition in its place, if he is so advised, within six weeks from today. If the revision petition is filled by the petitioner within the said period of six weeks from today, the period taken from today onwards till filing of the revision petition shall not be counted towards period of limitation. Certified copies, if any, may be returned to the appellant as per rules, if he so requires. Registry is requested to send a copy each of this Order to both the parties and to their learned counsel. |
